1. Acceptance of Terms
By accessing or using the system provided by Leanlink ("Service"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Services Provided
Leanlink AB (“Leanlink”) provides a software-as-a-service (SaaS) platform for staffing, recruitment and reference solutions. The Service includes, but is not limited to, job postings, collection of candidates, candidate management and analytics tools.
3. User Responsibilities
Account Creation: Users must provide accurate and complete information during account creation and maintain the security of their login credentials.
User Types: Please note that on signup a company account will be created connected to the user. The user that signs up (“Initial User”) will have administrator privileges and has the possibility to create additional users within this account. For all purposes and intents the term user will refer to all users, including the Initial User and created users, within the company account created by the Initial User. The term Administrator will refer to all users with administrative rights within that company account.
Compliance: Users must comply with all applicable laws and regulations related to employment and data protection in their respective jurisdictions.
Prohibited Activities: Users must not misuse the Service, including but not limited to, posting false information, infringing on intellectual property rights, or distributing malware.
4. Subscription and Payment
Subscription Plans: The Service is offered on a subscription basis with various plans available. When signing up the user is created on a trial plan. The trial plan grats the user possibility to create and take references on two candidates. Thereafter the user have to sign up for a paid plan. Details of each plan, including pricing, are provided upon creating a paid account.
Payment Terms: Subscription fees are billed in accordance with each subscription plan.
Signup: Initial Users may sign up for a trial plan through our webpage.
Renewal and Cancellation: Subscriptions automatically renew in accordance with each subscription plan.
5. Data Protection and Privacy
Data Collection: Leanlink collects and processes personal data in accordance with our Privacy Policy.
Data Usage: Users grant Leanlink the right to use data entered into the Service for the purpose of providing and improving the Service.
Confidentiality: Leanlink will maintain the confidentiality of user data and will not disclose it to third parties without user consent, except as required by law. Please note that the system has functions for posting data to the internet and confidentiality does not apply to information which any user within the same company account has posted or otherwise made public.
GDPR Compliance: Where applicable, both parties agree to comply with the General Data Protection Regulation (GDPR). The user or any company or legal entity that the user acts on behalf of when using the system acts as the Data Controller, and Leanlink acts as the Data Processor. Both parties agree to uphold their respective responsibilities under GDPR, including data subject rights, data breach notifications, and conducting Data Protection Impact Assessments (DPIAs) if necessary.
6. Roles and Responsibilities under GDPR
The term Customer below refers to the user or any company or legal entity that the user acts on behalf of when using the system if GDPR is applicable to the usage of the system. Where GDPR is not applicable to the usage of the system, this section may be disregarded.
Customer as Data Controller: The customer is responsible for determining the purposes and means of processing personal data. The customer must ensure that they have a lawful basis for processing the personal data they input into the Service.
Supplier as Data Processor: Leanlink processes personal data on behalf of the customer as per their instructions.
Leanlink will:
Process personal data only on documented instructions from the customer.
Ensure that persons authorised to process the personal data have committed themselves to confidentiality.
Implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk.
Assist the customer in ensuring compliance with their obligations under GDPR, including data subject rights and data breach notifications.
At the choice of the customer, delete or return all personal data to the customer after the end of the provision of services, and delete existing copies unless EU or Member State law requires storage of the personal data.
Make available to the customer all information necessary to demonstrate compliance with these obligations and allow for and contribute to audits, including inspections, conducted by the customer or another auditor mandated by the customer.
7. Intellectual Property
Ownership: Leanlink retains all rights, title, and interest in and to the Service, including all related intellectual property rights.
Licence: Users are granted a limited, non-exclusive, non-transferable licence to access and use the Service in accordance with these Terms and terms later agreed upon by the parties.
8. Limitation of Liability
No Warranty: The Service is provided "as is" without any warranties, express or implied. Leanlink does not guarantee the accuracy, completeness, or reliability of the Service.
Liability Limit: Leanlink shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the use or inability to use the Service.
9. Indemnification
Users and, if applicable, the organisations or other legal entity that the user acts on behalf as when using the system agree to indemnify and hold harmless Leanlink, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising out of or related to the user's use of the Service or violation of these Terms.
10. Modification of Terms
Leanlink reserves the right to modify these Terms at any time. Users will be notified of any material changes, and continued use of the Service constitutes acceptance of the modified Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.
